Postgender Fiqh: The Views of MUI’s and KUPI’s Ulema on Postgenderism from Maqāṣid Sharī’ah Perspective

This study aims to formulate the paradigm of fiqh (Islamic law) in predicting various impacts postgenderism by exploring postgender preferences according MUI (Indonesian Council Ulema) and KUPI Women Ulema Congress) scholars. qualitative research begins with examining perceptions ulema (Muslim scholars) both organizations regarding postgenderism. Primary data about on were explored through in-depth interviews four ulema, two from each organization. Secondary obtained literature exploration primary books articles postgender. Data analysis techniques employed spiral equipped content, comparative, critical analysis. The findings show that: 1) based maqāṣid sharī'ah laws’ objectives), view that ideologies movement threaten human existence risk establishment ḥifẓ al-dīn, al-nasl al-‘irḍ (preserving one’s religion, offspring, dignity respectively) 2) is considered as an ideology allegedly violates sunnatullah (God’s laws) threatens humanity. Therefore, every activity, facility, infrastructure, opportunity born it humanity must be avoided much possible. One preventive paradigms against formulated uṣūl iftirāḍi (preventive Islamic law’s fundament) method anticipatory ijtihād (intellectual exercise) towards its possible harms.
